Zone Change at 6011 W. 44th Avenue

The applicant is requesting approval of a zone change at 6011 W. 44th Avenue from Restricted Commercial (RC) to Mixed Use-Commercial (MU-C). The zone change will result in a a zoning that more accurately reflects surrounding conditions and other nearby zoning designations.
 This meeting will be conducted as a virtual meeting and in person in City Council Chambers (7500 W. 29th Avenue) if allowed to meet in person on that date per COVID-19 restrictions. Zone Change Review Criteria
Per Section 26-112 of the City Code, the planning commission and city council shall base its decision in consideration of the extent to which the applicant demonstrates the following criteria have been met. An analysis of these criteria are provided in the staff report linked above.
1. The change of zone promotes the health, safety, and general welfare of the community and will not result in a significant adverse effect on the surrounding area; and
2. Adequate infrastructure/facilities are available to serve the types of uses allowed by the change of zone, or the applicant will upgrade and provide such where they do not exist or are under capacity; and
3. At least one (1) of the following conditions exists:
a. The change of zone is in conformance, or will bring the property into conformance with, the City of Wheat Ridge comprehensive plan goals, objectives and policies, and other city-approved policies or plans for the area.
b. The existing zone classification currently recorded on the official zoning maps of the City of Wheat Ridge is in error.
c. A change of character in the area has occurred or is occurring to such a degree that it is in the public interest to encourage redevelopment of the area or to recognize the changing character of the area.
d. The proposed rezoning is necessary in order to provide for a community need that was not anticipated at the time of the adoption of the City of Wheat Ridge comprehensive plan.

Re: Application for zone change 6011 W. 44th (formerly US Bank) The information provided by the city in the ‘Letter Notice’ and the online ‘Zone Change’ video ( are quite insubstantial on detail. Also, an information search on the company, P Street I LLC, pursuing the zone change application, is vague at best. The lack of substance in information (perhaps intentionally) raises suspicions that WR is hoping to build a multi-dwelling residential building with businesses, much like the ‘West 38’ apartments on 38th & Upham St. Please know that if this is the city’s intent, I am fervently opposed to such a proposal. I have numerous concerns, but my primary concern is the increasing out-of-control traffic congestion on Harlan St and 44th Ave. At certain times of the day it is next to impossible to turn onto Harlan St. Harlan has become the go-to North/South route to avoid Wadsworth. Since 38th Ave has been reduced to two lanes (between Sheridan & Wadsworth), traffic on 44th has increased significantly. My surrounding neighbors are unanimously in agreement on this.
