Residential Bulk Plane - Code Amendment

This ordinance amends the zoning code such that bulk plane regulations apply to all detached single-unit homes in all R-series residential zone districts (R-1, R-1A, R-1B, R-1C, R-2, R-2A, R 3, and R-3A). A bulk plane standard adds a diagonal limit of construction for the purpose of limiting the mass and scale of a home and accessory structures. By adding a diagonal limit, a structure, or the upper story of a structure, is required to increase its distance from the property line as it gets taller. Bulk plane currently applies to single-unit homes only in the R-1C and R-3 zone districts, and this ordinance expands the applicability of bulk plane.

Adoption of the Lutheran Legacy Campus Master Plan

The Lutheran Medical Campus is located at 8300 W. 38th Avenue in the heart of Wheat Ridge. A new Lutheran hospital is being constructed at the Clear Creek Crossing development at the western edge of the City, and this move presents a rare opportunity to create a community vision for the future of the Lutheran Legacy Campus. The Lutheran Legacy Campus Master Plan is the culmination of five months of input from Wheat Ridge residents. The purpose of this master plan is to outline a 20-year vision for the property. It includes an overall development framework and detailed descriptions of the suitability of different land uses within the site. It summarizes key considerations for development within different zones of the property. It creates clear direction for future entitlements and rezonings, and it provides a menu of financing options to explore. The City’s 2009 comprehensive plan, Envision Wheat Ridge, did not contemplate a potential chance of use on the property, so adoption of this master plan is a critical next in a new chapter for the property. After a public hearing before the Planning Commission, the City Council will hold a public hearing on October 25 to make a final decision on adoption of the plan.

Code Amendment for Extended Stay Lodging

In the zoning code, hotels and motels are currently permitted with a Special Use Permit (SUP) in the Commercial-One (C-1), Commercial-Two (C-2), and Industrial Employment (IE) zone districts. In the mixed use zone districts, hotels, motels and extended stay lodging are permitted in all zones. The purpose of this code amendment as it pertains to the Planning Commission review and Chapter 26 of the City Code (the zoning code) is to add extended stay lodging as a special use in the C-1 and C-2 zone districts. Additional licensing requirements for extended stay lodging are proposed in the ordinance for Chapter 11 of the City Code. The Planning Commission has jurisdiction over any amendment in Chapter 26. City Council will conduct a public hearing later in October which will review all chapters of the City Code which are amended by the ordinance.

Code Amendment - Outdoor Recreational Equipment

In 2020, many public recreational facilities were closed for extended periods of time due to the COVID-19 pandemic. The purchase of personal recreational equipment was on the rise, including everything from trampolines to basketball hoops, swimming pools to swing sets. With the increased prevalence and scale of personal recreation equipment on private residential property, City Council directed staff to review the applicable codes and policies in the City and in neighboring communities. Study sessions with City Council were conducted on June 7 and August 9, 2021. Based on the increase in personal recreational equipment in the past year and also based on a specific homemade half pipe that exceeds 1000 square feet in size in a residential backyard, City Council directed staff to amend the code. The policy intent is to allow for reasonable, common sense enjoyment of recreational equipment in residential yards.

At City Council’s request, staff has reviewed the requirements associated with sign and letter notice, and this code amendment changes current practice in two ways: 1) it increases the number of posted signs based on frontage length and parcel configuration, and 2) it increases the letter notice radius from 300 feet to 6oo feet.

Code Amendment - Massage Businesses

The City Council recently approved an extensive revision of the system for the regulation and licensing of the practice of massage in the City. That change to the licensing framework is contained in Chapter 11 of the Code of Laws (Licenses and Permits). The changes to that chapter include revising the terminology of the regulated activities to use the more inclusive term “massage business,” rather than “massage parlor,” “massage therapist” or “massage therapy center.” These terms are also used in Chapter 26 in the various use charts and for definitional purposes, so this ordinance updates the references in Chapter 26 to match the new terminology now used in Chapter 11.
